Acjonline.in (“the Site”) is a platform providing legal information/data (“the Database”) published by Accidents Claims Journal, Delhi (“the Publisher”) in its monthly journal, namely, Accidents Claims Journal (“the Journal”).
Website Licence:
(a) The Publisher will grant the party/person subscribing to the Site (“the Subscriber”) a non-transferable, non-exclusive, revocable, limited licence to access and use for research and educational purpose the Database available on the Site (“the Services or Service”).
(b) The Database may only be accessed or Services may only be used by the Subscriber or his authorised person(s) on no more than one device at a time.
(c) The Licence includes the right to view data; download and temporarily store in substantial portion of data; reproduce, quote, taking extracts in Subscriber’s own work products and create print-outs.
Errors:
(a) The Publisher does not have absolute control over the contents posted on the Site and hence does not guarantee the accuracy, quality or integrity of such content and does not warrant that information provided on the Site will be uninterrupted or timely, error free, free of viruses or other harmful components, or the defects will be corrected.
Subscription:
(a) In order to become a Subscriber a person/party has to pay the Subscription amount applicable.
(b) The Subscription amount will be charged annually (“Subscription Period”). Payment of Subscription will entitle a Subscriber to have access of the Site for one year from the date of payment of the Subscription amount and shall automatically terminate on expiry of Subscription Period. A Subscriber may renew his Subscription from expiry of his Subscription Period.
(c) The Subscription amount paid is non–refundable. All taxes, fees and duties existing and/or subsequently imposed are to be borne by the Subscriber.
Termination:
(a) The Publisher may, in its sole discretion, terminate the Licence if there is (a) violation of the terms of the Licence, or (b) any misuse or overuse of the Database by the Subscriber and no part of the Subscription amount would be refundable.
(b) On termination of the Licence, the Subscriber shall immediately cease to have any rights or licence in respect of the Database or any part of it.
Copyright:
(a) The Subscriber agrees that the copyright in the Database vests solely in the Publisher and the Publisher retains title to and ownership of the original and all copies of the Journal, regardless of the form or media in or on which the original or other copies may exist.
Exclusion of Liability:
(a)The Publisher shall not be liable for failure to perform its obligations if the failures result from an act of God, an act of Government, other authorities or statutory undertakings, fire, explosion, accident, power failure, equipment or systems failure, industrial dispute or anything beyond the Publisher's control (whether or not caused by the negligence of the Publisher).
(b) The publisher shall not be responsible if any information/page is downloaded from the Site and after downloading complete/partial information/text is altered/removed/obscured contained therein.
(b) Without prejudice, in no event shall the Publisher be liable to Subscriber for any claim(s) relating in any way to:
(i) Any indirect, incidental or consequential loss, loss of profit, revenue, data or goodwill howsoever arising suffered by the Subscriber arising under or in connection with these terms or conditions (including without limitation in respect of the Subscriber’s use or misuse of, or inability to use the Database or any part of it) or for any wasted management time, costs or expenses arising from such damage or loss (whether or not caused by the negligence of the Publisher).
(ii) The unavailability of the Site or any portion thereof.
Intellectual Property Rights:
(a) The Subscriber acknowledges that he/it obtains no copyright or other right in the nature of copyright or any other intellectual property right whatsoever in the Service or any part thereof or in the Database, or print-out by virtue of this Licence.
(b) This Licence is not a sale of the original or any copy of the Database, and nothing contained in this Licence shall be construed as granting or otherwise transferring to the Subscriber any copyright or ownership interest whatsoever in the Database.
(c) Any rights not expressly granted herein are reserved.
Privacy:

The Subscriber shall fully indemnify and hold the Publisher harmless for all costs, damages, losses and expenses (including all reasonably incurred legal expenses) whether arising in contract, tort, under statute (including in each case negligence) or otherwise incurred by the Publisher which arise in connection with any misuse or overuse by the Subscriber, any authorised person or any other third party of the Database or any part thereof, or otherwise in connection with any breach by the Subscriber of these terms and conditions.
This End User Agreement and its Terms and Conditions shall be governed by and construed in accordance with Indian law.
No Waiver: Any delay or forbearance by the Publisher or the Subscriber in enforcing any provisions of this Licence or any of its rights hereunder shall not be construed as a waiver of such provision or right thereafter to enforce the same.
